  1. \t\tO agravamento da responsabilidade originado pela falta de observa\u00e7\u00e3o, por parte do empregador, das regras sobre seguran\u00e7a e sa\u00fade no trabalho, tem como fonte o contrato de trabalho celebrado entre o sinistrado e a R\u00e9 patronal.<\/li>\n
  2. \t\tEstamos perante uma responsabilidade contratual, ou seja, o empregador v\u00ea a sua responsabilidade derivada do contrato, agravada, por for\u00e7a da viola\u00e7\u00e3o das regras de seguran\u00e7a e sa\u00fade no trabalho<\/li>\n
  3. \t\tO artigo 18.\u00ba da LAT, quando remete para os termos gerais, n\u00e3o estabelece qualquer responsabilidade extracontratual, f\u00e1-lo com vista \u00e0 fixa\u00e7\u00e3o da indemniza\u00e7\u00e3o nos termos gerais do direito civil.<\/li>\n
  4. \t\tPerante uma responsabilidade contratual, o prazo de prescri\u00e7\u00e3o \u00e9 o prazo ordin\u00e1rio de vinte anos previsto no artigo 309.\u00ba do CC e n\u00e3o o de tr\u00eas anos estabelecido no n.\u00ba 1 do artigo 498.\u00ba do CC para o direito de indemniza\u00e7\u00e3o por factos il\u00edcitos (artigo 483.\u00ba e segs. do CC). <\/li>\n<\/ol>\n
