  1. \t\tA refer\u00eancia normativa \u201csem justa causa\u201d constante do n.\u00ba 2 do artigo 360.\u00ba do CP n\u00e3o integra o tipo objectivo do crime de \u201crecusa a depor\u201d, constituindo a \u201cjusta causa\u201d dessa recusa uma circunst\u00e2ncia dirimente da ilicitude.<\/li>\n
  2. \t\tTendo presente o car\u00e1cter geral e abstracto dos tipos justificadores, bem como o leque de situa\u00e7\u00f5es pass\u00edveis de consubstanciar causas de justifica\u00e7\u00e3o, n\u00e3o \u00e9 exig\u00edvel que a acusa\u00e7\u00e3o tenha de narrar factos destinados a demonstrar a inexist\u00eancia de qualquer causa de exclus\u00e3o da ilicitude.<\/li>\n
  3. \t\tA recusa de o arguido prestar, enquanto testemunha, perante um agente da PSP, declara\u00e7\u00f5es em processo no qual se investigava a pr\u00e1tica de um crime de ofensa \u00e0 integridade f\u00edsica e onde ent\u00e3o era arguido um recluso, sob invoca\u00e7\u00e3o de se ter de \u201cproteger no estabelecimento prisional\u201d onde tamb\u00e9m estava preso, n\u00e3o legitima (justifica) a referida omiss\u00e3o.<\/li>\n
  4. \t\tN\u00e3o obstante as dificuldades acrescidas na viv\u00eancia no interior de estabelecimento prisional, designadamente quanto aos \u201cdiferendos\u201d que se podem gerar, compete \u00e0s inst\u00e2ncias formais, designadamente \u00e0 Direc\u00e7\u00e3o daquela institui\u00e7\u00e3o e, afinal, ao Estado, prover \u00e0 seguran\u00e7a\/protec\u00e7\u00e3o dos reclusos. <\/li>\n<\/ol>\n
