  1. \t\tUma senten\u00e7a homologat\u00f3ria de transac\u00e7\u00e3o em que interveio mandat\u00e1rio sem poderes especiais \u00e9 ineficaz em rela\u00e7\u00e3o ao mandante, se n\u00e3o for pessoalmente notificado, nos termos e para os efeitos do art.291 n\u00ba3 CPC.<\/li>\n
  2. \t\tO art.291 n\u00ba3 do CPC configura um regime especial da nulidade com base na falta de poderes do mandat\u00e1rio ou da irregularidade do mandato.<\/li>\n
  3. \t\tA falta de notifica\u00e7\u00e3o pessoal n\u00e3o pode ser suprida com a notifica\u00e7\u00e3o da senten\u00e7a ao mandat\u00e1rio.<\/li>\n
  4. \t\tA senten\u00e7a homologat\u00f3ria s\u00f3 transita em julgado se houver notifica\u00e7\u00e3o pessoal ao mandante, pelo que inexistindo tr\u00e2nsito em julgado da senten\u00e7a a mesma n\u00e3o \u00e9 exequ\u00edvel, constituindo fundamento de oposi\u00e7\u00e3o \u00e0 execu\u00e7\u00e3o. <\/li>\n<\/ol>\n
