\t<strong>Legisla\u00e7\u00e3o:<\/strong> ARTS.726 CPC, 1041 CC, 14-A NRAU<br \/> \t<strong>Sum\u00e1rio:<\/strong><\/p>\n<ol>\n<li style=\"text-align: justify;\"> \t\tSe, em execu\u00e7\u00e3o para pagamento de quantia certa, tendo como t\u00edtulo executivo composto o contrato de arrendamento urbano e o comprovativo de comunica\u00e7\u00e3o ao arrendat\u00e1rio do montante em d\u00edvida (art.\u00ba 14.\u00ba-A do NRAU), o exequente vem formular pedido de indemniza\u00e7\u00e3o agravada a que alude o art.\u00ba 1041.\u00ba, n.\u00ba 1, do CCiv., cabe-lhe alegar, no requerimento executivo, o modo de extin\u00e7\u00e3o do v\u00ednculo contratual, de molde a afastar a hip\u00f3tese de resolu\u00e7\u00e3o do contrato com base em falta de pagamento.<\/li>\n<li style=\"text-align: justify;\"> \t\tN\u00e3o tendo procedido a tal alega\u00e7\u00e3o, mediante factos concretizadores do modo de extin\u00e7\u00e3o do contrato, ocorre insufici\u00eancia de alega\u00e7\u00e3o f\u00e1ctica necess\u00e1ria, justificativa do convite ao aperfei\u00e7oamento do requerimento executivo, para que seja suprida a falta, nos termos do disposto no art.\u00ba 726.\u00ba, n.\u00ba 4, do NCPCiv..<\/li>\n<li style=\"text-align: justify;\"> \t\tEm tal caso, o indeferimento parcial do requerimento executivo s\u00f3 se justifica se a falta de alega\u00e7\u00e3o n\u00e3o for corrigida no prazo fixado (n.\u00ba 5 do mesmo art.\u00ba), n\u00e3o sendo caso de indeferimento liminar parcial (cfr. n.\u00ba 3 daquele art.\u00ba).<\/li>\n<li style=\"text-align: justify;\"> \t\tSe do contrato de arrendamento consta uma cl\u00e1usula sobre \u201ctodas as obras a efectuar\u201d e licenciamento a obter, sem fixa\u00e7\u00e3o de qualquer dever indemnizat\u00f3rio, mas apenas a \u201cresponsabilidade\u201d por tais obras e licenciamento, tal n\u00e3o constitui t\u00edtulo para execu\u00e7\u00e3o por cr\u00e9dito indemnizat\u00f3rio relativo ao custo de reposi\u00e7\u00e3o do locado no estado anterior ao arrendamento, cr\u00e9dito esse que n\u00e3o poderia ser unilateralmente fixado por uma das partes, mas que teria de ser objeto de fixa\u00e7\u00e3o judicial
