N\u00ba 321-B\/90 15\/10 ( RAU), LEI N\u00ba 6\/2006 DE 27\/12 ( NRAU), LEI N\u00ba 31\/2012 DE 14\/8<br \/> \t<strong>Sum\u00e1rio: <\/strong><\/p>\n<ol>\n<li style=\"text-align: justify;\"> \t\tEstando em causa o pagamento de rendas como fundamento do pedido de despejo, n\u00e3o \u00e9 apropriado afirmar na mat\u00e9ria de facto provada que as rendas foram pagas, porque esta afirma\u00e7\u00e3o j\u00e1 cont\u00e9m em si uma valora\u00e7\u00e3o jur\u00eddica relevante para o desfecho da a\u00e7\u00e3o.<\/li>\n<li style=\"text-align: justify;\"> \t\tSendo impugnado o conte\u00fado declarativo \u00abas rendas foram pagas\u00bb que consta da mat\u00e9ria de facto, pretendendo-se que o mesmo seja declarado \u00abn\u00e3o provado\u00bb, a solu\u00e7\u00e3o consiste n\u00e3o na sua pura supress\u00e3o, mas sim na convers\u00e3o da afirma\u00e7\u00e3o de \u00edndole jur\u00eddica impugnada na afirma\u00e7\u00e3o dos dados hist\u00f3ricos que lhe serviram e servem de substrato.<\/li>\n<li style=\"text-align: justify;\"> \t\tQuando no pro\u00e9mio do n.\u00ba 4 do artigo 26.\u00ba do Novo Regime do Arrendamento Urbano, institu\u00eddo pela Lei n.\u00ba 6\/2006, de 27 de fevereiro, se estabelece que \u00abOs contratos sem dura\u00e7\u00e3o limitada regem-se pelas regras aplic\u00e1veis aos contratos de dura\u00e7\u00e3o indeterminada, com as seguintes especificidades:\u2026\u00bb, est\u00e1 a dizer-se que os contratos anteriores ao RAU s\u00e3o considerados, por esta norma, como contratos de dura\u00e7\u00e3o indeterminada e est\u00e3o abrangidos pelo Regime Transit\u00f3rio estabelecido no NRAU nos artigos 26.\u00ba a 58.\u00ba.<\/li>\n<li style=\"text-align: justify;\"> \t\tPara existir mora do arrendat\u00e1rio quanto ao pagamento das rendas torna-se necess\u00e1rio que dos factos provados resulte o local onde a renda devia ser paga e que o arrendat\u00e1rio n\u00e3o procedeu nesse local \u00e0 entrega da
