  1. \t\tO diferente enquadramento jur\u00eddico dos factos imputados ao trabalhador na nota de culpa, permanecendo estes inalterados, n\u00e3o consubstancia qualquer invoca\u00e7\u00e3o de factos n\u00e3o constantes da nota de culpa vedada pelo art\u00ba 357\u00ba\/4 do CT\/2009.<\/li>\n
  2. \t\tO princ\u00edpio constitucional \u2018a trabalho igual sal\u00e1rio igual\u2019 visa que nenhum trabalhador seja discriminado, em termos de retribui\u00e7\u00e3o, relativamente a outros trabalhadores que executem igual trabalho em termos de quantidade, natureza e qualidade, registando-se viola\u00e7\u00e3o desse princ\u00edpio se a diferencia\u00e7\u00e3o da retribui\u00e7\u00e3o n\u00e3o resultar de crit\u00e9rios objectivos.<\/li>\n
  3. \t\tA aplica\u00e7\u00e3o do art\u00ba 25\u00ba\/5 do CT\/2009 exige que o trabalhador alegue e prove factos que revelem o tratamento diferenciado e aqueles que constituam factores caracter\u00edsticos de discrimina\u00e7\u00e3o enunciados no art\u00ba 24\u00ba\/1 do CT\/2009. <\/li>\n<\/ol>\n
