  1. \t\tA raz\u00e3o de ser da impossibilidade em usucapir uma servid\u00e3o n\u00e3o aparente, que n\u00e3o se revela materialmente em termos inequ\u00edvocos, reside na preocupa\u00e7\u00e3o legal de se evitar tal constitui\u00e7\u00e3o em situa\u00e7\u00f5es em que a actua\u00e7\u00e3o\/posse \u00e9 exercida por mera toler\u00e2ncia do dono do dito pr\u00e9dio serviente ou, at\u00e9, sem que este dela tenha conhecimento.<\/li>\n
  2. \t\tA lei exige para que a aquisi\u00e7\u00e3o de servid\u00f5es de passagem por usucapi\u00e3o seja poss\u00edvel, factos inequivocamente demonstrativos da exist\u00eancia de situa\u00e7\u00f5es duradouras e vinculativas, isto \u00e9, a exist\u00eancia de sinais vis\u00edveis e permanentes \u2013 n\u00ba 2 do art. 1548\u00ba do C.Civil \u2013, que o mesmo \u00e9 dizer, demonstrativos da inexist\u00eancia de uma situa\u00e7\u00e3o prec\u00e1ria originada por actos de mera toler\u00e2ncia.<\/li>\n
  3. \t\tN\u00e3o basta existirem sinais vis\u00edveis, designadamente por o caminho ter sido \u201cfeito em terra batida\u201d, para se poder ou dever concluir que os mesmos eram ou foram permanentes.<\/li>\n
  4. \t\tAssim, n\u00e3o se tendo alegado (nem provado) existir qualquer sinal permanente no ou sobre o pr\u00e9dio dos RR., n\u00e3o \u00e9 poss\u00edvel constituir-se, por usucapi\u00e3o, a respetiva servid\u00e3o de passagem.<\/li>\n<\/ol>\n
