\tNas situa\u00e7\u00f5es em que j\u00e1 houve decis\u00e3o judicial fixando alimentos a favor menores, ainda que por senten\u00e7a homologat\u00f3ria de acordo relativo \u00e0s responsabilidades parentais, uma subsequente a\u00e7\u00e3o de alimentos, com alicerce nas situa\u00e7\u00f5es previstas no art\u00ba 1880\u00ba do C\u00f3digo Civil, intentada por um dos filhos contemplados em tal decis\u00e3o, consubstancia incidente de altera\u00e7\u00e3o que corre por apenso \u00e0 a\u00e7\u00e3o onde foram fixados os alimentos, sendo do respectivo tribunal \u2013 v.g., do Ju\u00edzo de Fam\u00edlia e Menores – a compet\u00eancia material para apreciar tal pretens\u00e3o.<\/p>\n
