  1. \t\tA al. c) do n\u00ba2 do artigo 266\u00ba do CPC apenas diz que a compensa\u00e7\u00e3o \u00e9 admiss\u00edvel como fundamento de reconven\u00e7\u00e3o e n\u00e3o que a compensa\u00e7\u00e3o s\u00f3 possa ser feita valer por esse meio.<\/li>\n
  2. \t\tA compensa\u00e7\u00e3o opera por mera declara\u00e7\u00e3o unilateral de uma das partes \u00e0 outra (n\u00ba1 do artigo 848\u00ba CC), tendo a extin\u00e7\u00e3o dos cr\u00e9ditos efic\u00e1cia retroativa ao momento em que os cr\u00e9ditos se tornaram compens\u00e1veis (artigo 854\u00ba CC).<\/li>\n
  3. \t\tEm processo onde seja vedada a dedu\u00e7\u00e3o de reconven\u00e7\u00e3o, ao r\u00e9u ter\u00e1 de ser facultada a possibilidade de invocar a compensa\u00e7\u00e3o por via de exce\u00e7\u00e3o, sob pena de lhe ser coartado um importante meio de defesa.<\/li>\n<\/ol>\n
