  1. \t\tNum contrato de execu\u00e7\u00e3o fracionada, o devedor pode recusar a realiza\u00e7\u00e3o da sua fra\u00e7\u00e3o da presta\u00e7\u00e3o por o credor n\u00e3o cumprir a fra\u00e7\u00e3o correspondente.<\/li>\n
  2. \t\tA invoca\u00e7\u00e3o da exce\u00e7\u00e3o do n\u00e3o cumprimento do contrato \u2013 art. 428\u00ba, n\u00ba1, do C\u00f3digo Civil – pode ser oposta ainda que haja vencimentos diferentes, apenas n\u00e3o podendo ser oposta pelo contraente que devia cumprir primeiro.<\/li>\n
