  1. \t\tTendo o processo por finalidade a entrega \u00e0 requerente de ve\u00edculo autom\u00f3vel, objecto de contrato de loca\u00e7\u00e3o financeira celebrado com a requerida, que cessou anteriormente \u00e0 declara\u00e7\u00e3o de insolv\u00eancia da locat\u00e1ria, n\u00e3o est\u00e1 em causa bem pertencente \u00e0 massa insolvente, mas antes \u00e0 pr\u00f3pria requerente.<\/li>\n
  2. \t\tUma vez que o bem objecto do contrato e cuja entrega \u00e9 pretendida tamb\u00e9m n\u00e3o foi apreendido para a massa insolvente, n\u00e3o \u00e9 caso de aplica\u00e7\u00e3o da situa\u00e7\u00e3o prevista no art. 141\u00ba, n\u00ba 1, a), do CIRE;<\/li>\n
  3. \t\tNum procedimento cautelar de entrega judicial, nos termos do art. 21\u00ba, n\u00ba 1, do DL 149\/95, de 24.6., intentado antes da declara\u00e7\u00e3o da insolv\u00eancia, caso se esteja perante a hip\u00f3tese referida em i), quer na situa\u00e7\u00e3o mencionada em ii), n\u00e3o deve ser proferida qualquer decis\u00e3o de absolvi\u00e7\u00e3o da inst\u00e2ncia (por nulidade do processo, por erro na forma do processo, ou por incompet\u00eancia material do tribunal de comarca).<\/li>\n<\/ol>\n
