  1. \t\tPerante o disposto no artigo 311.\u00ba, n.\u00bas 2 e 3, al. d), do CPP, o Tribunal s\u00f3 pode rejeitar a acusa\u00e7\u00e3o, considerando-a manifestamente infundada, quando a factualidade nela descrita n\u00e3o consagra de forma inequ\u00edvoca a conduta tipificadora do crime imputado ou de qualquer outro \u2013 neste \u00faltimo caso, no decurso do julgamento, haver\u00e1 que proceder em conformidade com o disposto no artigo 358.\u00ba do mesmo diploma legal.<\/li>\n
  2. \t\tA irrelev\u00e2ncia penal dos factos imputados ao arguido tem de ser manifesta, evidente, inequ\u00edvoca, n\u00e3o bastando, assim, que a qualifica\u00e7\u00e3o jur\u00eddica da factualidade da acusa\u00e7\u00e3o seja meramente discut\u00edvel, e discutida, por uma ou v\u00e1rias das correntes seguidas pela jurisprud\u00eancia.<\/li>\n<\/ol>\n
