  1. \t\tPerante a posi\u00e7\u00e3o processual do Minist\u00e9rio P\u00fablico de ordenar a notifica\u00e7\u00e3o do assistente para, querendo, deduzir acusa\u00e7\u00e3o, competia a este tomar uma de duas op\u00e7\u00f5es: – N\u00e3o se conformar com esta posi\u00e7\u00e3o do Minist\u00e9rio P\u00fablico quanto \u00e0 qualifica\u00e7\u00e3o do eventual crime de difama\u00e7\u00e3o (difama\u00e7\u00e3o simples) e requerer a abertura da instru\u00e7\u00e3o tendo em vista a sua integra\u00e7\u00e3o numa difama\u00e7\u00e3o agravada; ou – Deduzir acusa\u00e7\u00e3o particular mas t\u00e3o-somente pelo crime de difama\u00e7\u00e3o p. e p. pelo artigo 180.\u00ba, n.\u00ba 1, do CP (sem a agrava\u00e7\u00e3o do artigo 184.\u00ba do mesmo diploma).<\/li>\n
  2. \t\tN\u00e3o podia o assistente deduzir uma acusa\u00e7\u00e3o particular por um crime que, segundo a sua pr\u00f3pria qualifica\u00e7\u00e3o ou integra\u00e7\u00e3o jur\u00eddica, tem a natureza de crime semip\u00fablico, a difama\u00e7\u00e3o agravada.<\/li>\n<\/ol>\n
