  1. \t\tA descoberta, no decurso da audi\u00eancia de julgamento, de um evento f\u00e1ctico totalmente novo, ou seja, n\u00e3o constante da acusa\u00e7\u00e3o, n\u00e3o pode pertencer \u00e0 categoria de altera\u00e7\u00e3o substancial dos factos descritos naquela pe\u00e7a processual, porquanto esse instituto exige a manuten\u00e7\u00e3o do mesmo evento, embora em circunst\u00e2ncias, n\u00e3o constantes do libelo acusat\u00f3rio, determinantes da imputa\u00e7\u00e3o de crime diverso ou da agrava\u00e7\u00e3o dos limites m\u00e1ximos das san\u00e7\u00f5es aplic\u00e1veis (cfr. artigos 359.\u00ba e 1.\u00ba, al\u00ednea f), do CPP.<\/li>\n
  2. \t\tDito de outra forma, a no\u00e7\u00e3o de altera\u00e7\u00e3o substancial implica sempre que os factos novos descobertos em julgamento tenham uma liga\u00e7\u00e3o natural\u00edstica com os factos narrados na acusa\u00e7\u00e3o, sejam o desenvolvimento decorrente de um melhor conhecimento das circunst\u00e2ncias em que ocorreram.<\/li>\n<\/ol>\n
