  1. \t\tO Empreiteiro deve executar a obra em conformidade com o que foi convencionado, e sem v\u00edcios que excluam ou reduzam o seu valor, ou aptid\u00e3o para o uso ordin\u00e1rio ou previsto no contrato (cfr. art.\u00ba 1208\u00ba do mesmo diploma), o que n\u00e3o \u00e9 sen\u00e3o o corol\u00e1rio a que qualquer devedor est\u00e1 vinculado no cumprimento das suas obriga\u00e7\u00f5es, quais sejam \u2013 a presta\u00e7\u00e3o deve ser pontualmente cumprida \u2013 artigo 406\u00ba, 1, e 762\u00ba, 1, do CC, o solvens deve agir nos termos impostos pela boa-f\u00e9 \u2013 artigo 762\u00ba, 2, do CC e a presta\u00e7\u00e3o deve ser efetuada integralmente \u2013 artigo 763\u00ba do CC.<\/li>\n
  2. \t\tN\u00e3o \u00e9 qualquer tipo de incumprimento que pode determinar a resolu\u00e7\u00e3o do contrato de empreitada, tem de haver um incumprimento definitivo.<\/li>\n
  3. \t\tPara que haja incumprimento definitivo torna-se necess\u00e1rio saber se h\u00e1 ou n\u00e3o inadimplemento, isto \u00e9, saber se h\u00e1 desconformidade entre a execu\u00e7\u00e3o e o conte\u00fado do contrato.<\/li>\n<\/ol>\n
