  1. \t\tA declara\u00e7\u00e3o do justo impedimento, de cariz excecional porque tardiamente afetante de direitos da outra parte, importa, por banda da parte impetrante, a clara prova de que o evento obstaculizante da pr\u00e1tica atempada do ato processual n\u00e3o lhe \u00e9 imput\u00e1vel a t\u00edtulo de culpa ou neglig\u00eancia \u2013 art\u00bas 487\u00ba n\u00ba2 e 342\u00ba n\u00ba2 do CC.<\/li>\n
  2. \t\tSe a r\u00e9, empresa multinacional supostamente bem organizada e assessorada, na sequ\u00eancia da morte do seu advogado em 17.12.2015, n\u00e3o d\u00e1 conhecimento do facto e apenas junta ao processo nova procura\u00e7\u00e3o em 24.03.2016, sem provar causa justificativa para tal delonga, n\u00e3o pode beneficiar de tal figura jur\u00eddica e, assim, ser-lhe concedido prazo adicional para recorrer da senten\u00e7a que naquele \u00ednterim foi notificada ao falecido mandat\u00e1rio e cujo prazo j\u00e1 tinha decorrido.<\/li>\n<\/ol>\n
