  1. \t\tTem sido entendido de forma pac\u00edfica que a lei aplic\u00e1vel \u00e0 gradua\u00e7\u00e3o de cr\u00e9ditos em processo de insolv\u00eancia \u00e9 a que se encontra em vigor na data do tr\u00e2nsito em julgado da senten\u00e7a que a declara.<\/li>\n
  2. \t\tSegundo a previs\u00e3o normativa \u2013 art\u00ba 333\u00ba C. Trabalho -, atendendo \u00e0 causa do cr\u00e9dito – emergente de contrato de trabalho, ou da sua viola\u00e7\u00e3o ou cessa\u00e7\u00e3o – o mesmo goza de privil\u00e9gio imobili\u00e1rio especial sobre o bem im\u00f3vel do empregador em que o trabalhador\/credor presta a sua actividade.<\/li>\n
  3. \t\tNesse conceito n\u00e3o est\u00e3o abrangidos \u00e0 partida todos os im\u00f3veis que integram o patrim\u00f3nio do empregador, devendo existir e sendo cognosc\u00edvel a necess\u00e1ria conex\u00e3o entre o cr\u00e9dito e o(s) bem(ns) onerado(s) com a garantia: trata-se dos im\u00f3veis que pelo empregador estejam afectados de forma est\u00e1vel \u00e0 sua organiza\u00e7\u00e3o empresarial, tendo em vista o desenvolvimento da sua actividade, para a qual contribui a presta\u00e7\u00e3o de que emerge o cr\u00e9dito laboral garantido.<\/li>\n<\/ol>\n
