  1. \t\tSe entre os tipos penais violados n\u00e3o se d\u00e1 uma rela\u00e7\u00e3o de exclus\u00e3o, ent\u00e3o ficamos perante o chamado concurso efetivo, verdadeiro ou puro.<\/li>\n
  2. \t\tPreenchendo os factos, quer os elementos constitutivos do crime de condu\u00e7\u00e3o perigosa de ve\u00edculo rodovi\u00e1rio, p. e p. pelo art. 291.\u00ba, n.\u00ba 1, al. b), do C.P., quer do crime de condu\u00e7\u00e3o de ve\u00edculo sem habilita\u00e7\u00e3o legal, p. e p. pelo art. 3.\u00ba, n.\u00bas 1 e 2, do Decreto-Lei n.\u00ba 2\/98, de 3\/01, sendo diferentes os bens jur\u00eddicos tutelados nos tipos e plurais as resolu\u00e7\u00f5es, praticou o arguido, em concurso real estes dois crimes.<\/li>\n<\/ol>\n
