  1. \t\tO cr\u00e9dito do Fundo de Garantia Autom\u00f3vel (FGA) emergente de falta dolosa de seguro obrigat\u00f3rio, n\u00e3o est\u00e1 abrangido pela exonera\u00e7\u00e3o do passivo restante, pois que cabe na previs\u00e3o do art.\u00ba 245\u00ba, n.\u00ba 2, al\u00ednea b), do CIRE.<\/li>\n
  2. \t\tO FGA adquire por via da sub-roga\u00e7\u00e3o legal o direito de cr\u00e9dito do lesado, consistente num direito de indemniza\u00e7\u00e3o devido por facto il\u00edcito negligente mas tal sub-roga\u00e7\u00e3o tem subjacente determinado quadro f\u00e1ctico e normativo, n\u00e3o se podendo ignorar o decisivo contributo do devedor\/insolvente, ao incumprir, dolosamente, o dever legal (e social\/comunit\u00e1rio) de segurar o ve\u00edculo de que era propriet\u00e1rio e que determinou a interven\u00e7\u00e3o do FGA.<\/li>\n<\/ol>\n
