  1. \t\tA declara\u00e7\u00e3o de inconstitucionalidade com for\u00e7a obrigat\u00f3ria geral produz efeitos desde a entrada em vigor do artigo 381\u00ba, n.\u00ba 1 do C\u00f3digo de Processo Penal, na reda\u00e7\u00e3o introduzida pela Lei n.\u00ba 20\/2013, de 21 de fevereiro e determina a repristina\u00e7\u00e3o da norma que ela revogou.<\/li>\n
  2. \t\tSendo aplic\u00e1vel a norma repristinada e n\u00e3o a norma declarada inconstitucional, verifica-se a nulidade insan\u00e1vel prevista no art.\u00ba 119.\u00ba, al\u00ednea f), o que determina a nulidade de todo o processado desde que foi ordenado que os autos seguissem a forma de processo sum\u00e1rio.<\/li>\n<\/ol>\n
