  1. \t\tEm todas as hip\u00f3teses de deser\u00e7\u00e3o da inst\u00e2ncia consideradas no art. 281.\u00ba do CPC se exige e alude \u00e0 \u201cneglig\u00eancia das partes\u201d.<\/li>\n
  2. \t\tAssim, embora o art. 281.\u00ba\/5 do CPC, a prop\u00f3sito do processo de execu\u00e7\u00e3o, diga que se \u201cconsidera deserta a inst\u00e2ncia, independentemente de qualquer decis\u00e3o judicial\u201d, tal n\u00e3o obsta a que, por despacho, se proceda \u00e0 aprecia\u00e7\u00e3o da imputa\u00e7\u00e3o subjectiva da paralisa\u00e7\u00e3o processual.<\/li>\n
  3. \t\tEstando apenas retratado nos autos, em termos de paralisa\u00e7\u00e3o processual, a aus\u00eancia de actos por parte do agente de execu\u00e7\u00e3o, tal \u00e9 insuficiente para, sem notificar o exequente para se pronunciar sobre tal paralisa\u00e7\u00e3o processual, estabelecer a sua neglig\u00eancia na paragem do processo.<\/li>\n<\/ol>\n
