\tPerante acidente de via\u00e7\u00e3o em que o lesado se transportava em ve\u00edculo motorizado (ciclomotor) – n\u00e3o se reportando, assim, o referido evento a utentes vulner\u00e1veis de vias p\u00fablicas (pe\u00f5es e ciclistas) -, sendo a outra viatura interveniente um autom\u00f3vel, o texto do artigo 505.\u00ba do CC n\u00e3o deve ser interpretado, de forma progressista ou actualista, no sentido de nele se acolher a regra do concurso da culpa do lesado com o risco do pr\u00f3prio ve\u00edculo autom\u00f3vel.<\/p>\n
