C\u00cdVEL<br \/> \t<strong>Legisla\u00e7\u00e3o: <\/strong>ART\u00baS 323\u00ba, N\u00ba 1 E 655\u00ba, N\u00ba 2 DO C.CIVIL.<br \/> \t<strong>Sum\u00e1rio:<\/strong><\/p>\n<ol>\n<li style=\"text-align: justify;\"> \t\tSe as partes n\u00e3o fixarem limite dos per\u00edodos de prorroga\u00e7\u00e3o do contrato de arrendamento, o n\u00ba 2 do art.655\u00ba do CC imp\u00f5e a extin\u00e7\u00e3o da fian\u00e7a no final do prazo que decorre da soma do prazo inicial do contrato com o prazo de cinco anos, tratando-se de uma fian\u00e7a por tempo determinado.<\/li>\n<li style=\"text-align: justify;\"> \t\tA presta\u00e7\u00e3o diz-se imposs\u00edvel quando n\u00e3o pode ser cumprida ou seja, quando se torna invi\u00e1vel a realiza\u00e7\u00e3o da presta\u00e7\u00e3o. \u00c9 origin\u00e1ria se for contempor\u00e2nea da forma\u00e7\u00e3o do neg\u00f3cio, e designa-se de superveniente quando, originariamente poss\u00edvel, deixou de o ser mais tarde.
