  1. \t\tConsiderada a fun\u00e7\u00e3o da seguran\u00e7a social e o espec\u00edfico regime de lay off previsto no C\u00f3digo de Trabalho, a entidade patronal recebe a compensa\u00e7\u00e3o remunerat\u00f3ria daquela institui\u00e7\u00e3o, n\u00e3o por direito pr\u00f3prio, mas antes por t\u00edtulo n\u00e3o translativo da propriedade, e com obriga\u00e7\u00e3o de a transferir para a titularidade do trabalhador, posto que a mesma se destina ao pagamento da remunera\u00e7\u00e3o deste.<\/li>\n
  2. \t\tEm conformidade, comete o crime de abuso de confian\u00e7a, p. e p. no artigo 295.\u00ba do CP, o legal representante de ente colectivo que afecta as compensa\u00e7\u00f5es remunerat\u00f3rias recebidas, no referido \u00e2mbito, da Seguran\u00e7a Social a diverso fim.<\/li>\n<\/ol>\n
