  1. \t\tA senten\u00e7a homologat\u00f3ria da partilha (art.\u00ba 1382\u00ba, n.\u00ba 1, do CPC de 1961), uma vez transitada em julgado, constitui t\u00edtulo executivo.<\/li>\n
  2. \t\tSe determinada verba for aprovada por todos os interessados e partilhada no invent\u00e1rio como d\u00edvida do casal, verifica-se o caso julgado relativamente ao credor que seja interessado no invent\u00e1rio, considerando-se a d\u00edvida judicialmente reconhecida e exig\u00edvel, ainda que falte a expressa condena\u00e7\u00e3o no seu pagamento a que alude a parte final do n.\u00ba 1 do art.\u00ba 1354\u00ba, do CPC de 1961.<\/li>\n
  3. \t\tCom o tr\u00e2nsito em julgado da senten\u00e7a que homologou a partilha ficou definitivamente fixado o direito dos intervenientes no processo de invent\u00e1rio, sendo que o direito da exequente (credor) ficou definido com rigor em sede de confer\u00eancia de interessados (competente para deliberar sobre a aprova\u00e7\u00e3o e forma de pagamento do passivo relacionado\/art.\u00ba 1353\u00ba, n.\u00ba 3, do CPC de 1961) e no mapa da partilha – o que a\u00ed se concretiza, em obedi\u00eancia ao acordado ou decidido no processo de invent\u00e1rio, dever\u00e1 pois ser cumprido\/executado.<\/li>\n
  4. \t\tDa\u00ed que assista legitimidade \u00e0 exequente para requerer a execu\u00e7\u00e3o da senten\u00e7a no que respeita ao pagamento de tal cr\u00e9dito, reconhecido no invent\u00e1rio, ou, dito doutra forma, cuja obriga\u00e7\u00e3o ficou declarada ou constitu\u00edda pela senten\u00e7a homologat\u00f3ria da partilha.<\/li>\n<\/ol>\n
