  1. \t\tO acto de reconhecimento n\u00e3o se confunde com o acto de declara\u00e7\u00f5es orais prestadas no \u00e2mbito do processo-crime.<\/li>\n
  2. \t\tNo primeiro, apura-se a identifica\u00e7\u00e3o do arguido, da pessoa que foi vista a praticar o il\u00edcito, enquanto que no segundo, perante uma pessoa j\u00e1 identificada, a testemunha e\/ou declarante aponta-a, identifica-a, como autora dos factos em discuss\u00e3o.<\/li>\n
  3. \t\tAssim, a prova por reconhecimento propriamente dita \u00e9 aut\u00f3noma, sujeita ao formalismo especial do art. 147.\u00ba e seguintes, do CPP, enquanto que a identifica\u00e7\u00e3o realizada por uma testemunha e\/ou declarante, no decurso da suas declara\u00e7\u00f5es, no decorrer da audi\u00eancia de julgamento, integra depoimento oral, que obedece \u00e0 regra geral da livre convic\u00e7\u00e3o e aprecia\u00e7\u00e3o da prova.<\/li>\n<\/ol>\n
