  1. \t\tConstituindo a oposi\u00e7\u00e3o \u00e0 execu\u00e7\u00e3o um incidente da ac\u00e7\u00e3o execu\u00adtiva, a confiss\u00e3o feita numa das contesta\u00e7\u00f5es apresentadas \u00e0 oposi\u00e7\u00e3o est\u00e1 abrangida pela previs\u00e3o do art.\u00ba 355\u00ba, n.\u00ba 3, do C. Civil, quando refere que \u201c\u2026a realizada em qualquer procedimento\u2026incidental\u2026vale como confiss\u00e3o judicial na ac\u00e7\u00e3o corres\u00adpondente\u201d.<\/li>\n
  2. \t\tO art.\u00ba 317\u00ba, b), do C. Civil exige, para funcionamento da presun\u00e7\u00e3o em causa, que sendo o adquirente dos bens comerciante os n\u00e3o destine ao seu com\u00e9rcio.<\/li>\n
  3. \t\tAs causas interruptivas da prescri\u00e7\u00e3o s\u00e3o tamb\u00e9m aplic\u00e1veis \u00e0s prescri\u00e7\u00f5es presuntivas, ex vi do art.\u00ba 315\u00ba do C. Civil, designadamente o reconhecimento do direito de cr\u00e9dito pelo devedor efectuado perante o respectivo titular, previsto no art.\u00ba 325\u00ba do mesmo diploma.<\/li>\n
  4. \t\tSe o devedor reconhece a exist\u00eancia de uma d\u00edvida sujeita a prescri\u00e7\u00e3o presuntiva, o prazo de prescri\u00e7\u00e3o em curso considera-se interrompido, iniciando-se o decurso de um novo prazo de prescri\u00e7\u00e3o presuntiva igual ao interrompido.<\/li>\n<\/ol>\n
