  1. \t\tO artigo 857.\u00ba do nCPC \u00e9 inconstitucional quando interpretado no sentido de que os fundamentos de embargos a execu\u00e7\u00e3o fundada em requerimento de injun\u00e7\u00e3o a que foi aposta f\u00f3rmula execut\u00f3ria se limitam aos fundamentos de embargos previstos no artigo 729\u00ba, do que resulta n\u00e3o se poder aplicar tal preceito.<\/li>\n
  2. \t\tNos embargos deduzidos numa execu\u00e7\u00e3o baseada na atribui\u00e7\u00e3o judicial de for\u00e7a executiva \u00e0 peti\u00e7\u00e3o da ac\u00e7\u00e3o especial para cumprimento de obriga\u00e7\u00f5es pecuni\u00e1rias subsequente \u00e0 falta de oposi\u00e7\u00e3o ao requerimento de injun\u00e7\u00e3o n\u00e3o se verifica tal inconstitucionalidade.<\/li>\n<\/ol>\n
