  1. \t\tA condu\u00e7\u00e3o, pelo arguido, de um ve\u00edculo pesado de mercadorias, ostentado o tac\u00f3grafo um disco diagrama em nome de terceiro, n\u00e3o integra o tipo objecto do crime de falsifica\u00e7\u00e3o de nota\u00e7\u00e3o t\u00e9cnica, p. e p. pelo art. 258.\u00ba, n.\u00ba 1, al. c) e 2, ex vi do art. 255\u00ba, al. b), ambos os normativos do CP.<\/li>\n
  2. \t\tEmbora o \u00abcart\u00e3o tacogr\u00e1fico\u00bb corporize um documento de identifica\u00e7\u00e3o, n\u00e3o se inclui na previs\u00e3o da al. c) do artigo 255.\u00ba do CP. III – Deste modo, a conduta acima referida tamb\u00e9m n\u00e3o preenche o tipo de crime de uso de documento de identifica\u00e7\u00e3o alheio do artigo 261.\u00ba do mesmo diploma.<\/li>\n<\/ol>\n
