  1. \t\tSe a assinatura aposta do local destinado ao subscritor\/emitente\/sacador do cheque foi efectuada por quem n\u00e3o dispunha de poderes de representa\u00e7\u00e3o da sociedade executada, tal n\u00e3o constitui um v\u00edcio de forma mas um v\u00edcio de subst\u00e2ncia contendendo com a validade material da pr\u00f3pria obriga\u00e7\u00e3o, opon\u00edvel (pela sociedade executada) a qualquer portador do cheque.<\/li>\n
  2. \t\tA obriga\u00e7\u00e3o \u00e9 assim nula por v\u00edcio de fundo (maxime, inefic\u00e1cia vinculativa da pr\u00f3pria declara\u00e7\u00e3o de vontade de se obrigar por banda da sociedade executada), com a consequente inefic\u00e1cia executiva do aludido t\u00edtulo.<\/li>\n
  3. \t\tPorque a executada fez valer em ju\u00edzo o que se lhe perspectivou como real ou veros\u00edmil, conjugando-o com as solu\u00e7\u00f5es plaus\u00edveis da quest\u00e3o de direito, tal actua\u00e7\u00e3o n\u00e3o excede os limites impostos pela boa f\u00e9, pelos bons costumes ou pelo fim social ou econ\u00f3mico desse direito (art.\u00ba 334\u00ba, do CC).<\/li>\n<\/ol>\n
