  1. \t\tEm princ\u00edpio, o avalista da subscritora de uma livran\u00e7a posiciona-se fora das rela\u00e7\u00f5es imediatas que se estabelecem entre o emitente desta e a subscritora, encontrando-se apenas numa rela\u00e7\u00e3o de imedia\u00e7\u00e3o com a subscritora avalizada.<\/li>\n
  2. \t\tMas j\u00e1 estar\u00e1 naquelas rela\u00e7\u00f5es imediatas, podendo defender-se com os v\u00edcios da rela\u00e7\u00e3o fundamental perante o credor-emitente-portador da livran\u00e7a, se, tendo assinado o t\u00edtulo em branco, for envolvido por esse emitente no pacto de preenchimento, ou com ele participar numa rela\u00e7\u00e3o extra-cartular que interfira nas condi\u00e7\u00f5es para esse preenchimento.<\/li>\n
  3. \t\tO avalista pode sempre opor ao credor cambi\u00e1rio o pagamento total ou parcial do cr\u00e9dito causal da emiss\u00e3o da livran\u00e7a, ainda que esse pagamento tenha sido efectuado pelo avalizado.<\/li>\n<\/ol>\n
