  1. Se o tribunal da condena\u00e7\u00e3o d\u00e1 como assentes factos que j\u00e1 constavam da acusa\u00e7\u00e3o – ainda que lhes confira um encadeamento diverso, mas sem que lhes retire a identidade natural\u00edstica -, n\u00e3o ocorre qualquer altera\u00e7\u00e3o relevante em mat\u00e9ria de facto, n\u00e3o sendo, assim, de cumprir o disposto no artigo 358.º, n.º 3, do CPP.<\/li>\n
  2. Do mesmo modo, se o tribunal descreve os mesmos factos por outras palavras, ou confere mais pormenor ao relato, apenas para precisar os termos da conduta, mas sem acrescentar nada de novo \u00e0 descri\u00e7\u00e3o da ac\u00e7\u00e3o t\u00edpica relevante, tamb\u00e9m n\u00e3o se verifica a referida altera\u00e7\u00e3o factual.<\/li>\n
  3. Efectivamente, aferindo-se a relev\u00e2ncia da altera\u00e7\u00e3o f\u00e1ctica em fun\u00e7\u00e3o da identidade do objecto do processo e do fair trial pressuposto por um processo penal justo, estes dois princ\u00edpios basilares n\u00e3o s\u00e3o minimamente afectados quando nenhuma novidade se acrescenta \u00e0 descri\u00e7\u00e3o, na acusa\u00e7\u00e3o, do comportamento t\u00edpico.\n
