  1. A quest\u00e3o da ineptid\u00e3o da peti\u00e7\u00e3o inicial, por incompatibilidade substancial de pedidos, n\u00e3o tendo sido suscitada, ainda que imperfeitamente, pela contestante, n\u00e3o deve ser conhecida pelo tribunal sem que se d\u00ea oportunidade ao Autor de se pronunciar sobre tal mat\u00e9ria, pois n\u00e3o se vislumbra que este procedimento seja de considerar como manifestamente desnecess\u00e1rio.<\/li>\n
  2. Tendo essa quest\u00e3o sido conhecida oficiosamente no saneador, sem preced\u00eancia da audi\u00e7\u00e3o do autor, h\u00e1 omiss\u00e3o de um acto que a lei imp\u00f5e (artº 3º, nº 3 do CPC).<\/li>\n
  3. \u00c0 Rela\u00e7\u00e3o n\u00e3o compete decidir em 1ª inst\u00e2ncia de nulidade processual cometida no Tribunal “a quo”, excepto (para al\u00e9m do caso previsto no art.º 205º, nº 3 do CPC) se se tratar de nulidade de conhecimento oficioso que n\u00e3o deva considerar-se sanada.\n
