  1. Para o efeito do artº 954º do CPC, o tribunal apenas poder\u00e1\/dever\u00e1, fixar a data do come\u00e7o da incapacidade, se a prova produzida for inequ\u00edvoca ou muito prov\u00e1vel sobre tal data.<\/li>\n
  2. Dadas as exig\u00eancias e cuidados neste particular legalmente exigidos, n\u00e3o pode considerar-se a data de realiza\u00e7\u00e3o de um relat\u00f3rio m\u00e9dico legal, no qual, apesar de se verificar que a examinanda tem j\u00e1 algumas vulnerabilidades f\u00edsicas e mentais, se conclui que \u00e9 ainda capaz de tomar decis\u00f5es assertivas; antes devendo considerar-se a data do seu internamento hospitalar, efectivado cerca de sete meses depois, e na decorr\u00eancia do agravamento de tais vulnerabilidades.\n
