  1. \u00c1 luz da redac\u00e7\u00e3o actual dos art.ºs 1º e 2º da Lei nº 75\/98, conferida pela Lei nº 66-B\/2012 de 31\/12 e do art.º 3º do DL 164\/99 de 13\/05, o Fundo de Garantia de Alimentos Devidos a Menores s\u00f3 \u00e9 chamado a responder quando o rendimento l\u00edquido do menor ou da pessoa a quem se encontre \u00e0 guarda n\u00e3o exceda o valor de 1 Indexante de Apoios Sociais.<\/li>\n
  2. Na determina\u00e7\u00e3o desse rendimento relevante h\u00e1 que calcular o montante que per capita cabe nos proventos globais do agregado familiar em que o menor se insere, utilizando-se para tanto os diversos factores de pondera\u00e7\u00e3o que a cada membro competem, nas percentagens que se acham definidos pelo art.º 5º do DL 70\/2010 de 16 de Junho.\n
