  1. N\u00e3o atribuindo a lei a uma concreta entidade a compet\u00eancia para ordenar o cumprimento do art.105.º, n.º4, al. b), do RGIT, esta notifica\u00e7\u00e3o pode ser ordenada pela entidade perante o qual estiver o processo quando a quest\u00e3o do seu cumprimento se vier a suscitar;<\/li>\n
  2. Estando o processo na fase de instru\u00e7\u00e3o e entendendo a Ex.ma JIC que essa notifica\u00e7\u00e3o do arguido e que anteriormente havia sido efetuada era irregular, tinha compet\u00eancia para ordenar essa mesma notifica\u00e7\u00e3o;<\/li>\n
  3. O que n\u00e3o podia, nem poder\u00e1, \u00e9 determinar "a devolu\u00e7\u00e3o dos autos ao Minist\u00e9rio P\u00fablico", deixando subentendida a exist\u00eancia de uma ordem ao Minist\u00e9rio P\u00fablico, para cumprir numa fase processual j\u00e1 ultrapassada, que seria o inqu\u00e9rito.\n
