  1. Sob pena de se verificar o v\u00edcio previsto na al.a) do nº2 do artigo 410º do CPP, nessa parte, o tribunal da 1ª inst\u00e2ncia deve fazer a investiga\u00e7\u00e3o plaus\u00edvel de fazer relativamente aos factos que possibilitem escolha e medida da pena.<\/li>\n
  2. Se da indaga\u00e7\u00e3o referida no n\u00famero anterior, n\u00e3o resultar aquele apuramento, deve ser claro na motiva\u00e7\u00e3o da mat\u00e9ria de facto que o tribunal fez as dilig\u00eancias que podia e devia fazer, no caso.<\/li>\n
  3. Quando o julgador da 1ª inst\u00e2ncia atribui, ou n\u00e3o, credibilidade a uma fonte de prova testemunhal ou por declara\u00e7\u00f5es, porque a op\u00e7\u00e3o tomada se funda na imedia\u00e7\u00e3o e na oralidade, o tribunal de recurso s\u00f3 a dever\u00e1 censurar quando for feita a demonstra\u00e7\u00e3o de que a op\u00e7\u00e3o tomada viola as regras da experi\u00eancia comum.
