Sum\u00e1rio: <\/strong><\/p>\n

  1. N\u00e3o \u00e9 legalmente admiss\u00edvel ao requerente da instru\u00e7\u00e3o proceder ao seu aperfei\u00e7oamento.<\/li>\n
  2. Quando o requerimento para abertura da instru\u00e7\u00e3o se mostrar contr\u00e1rio \u00e0s prescri\u00e7\u00f5es que regem para a formula\u00e7\u00e3o deste tipo de pr\u00e1tica processual, deve ser taxado de ilegal e, consequentemente, inadmitido, por ilegalidade.<\/li>\n
  3. A falta consubstanciadora da nulidade prevista no art.º 119, al. d), do CPP n\u00e3o se confunde com a insufici\u00eancia prevista no art.º 120º, n.º 1, al. d), do mesmo diploma. Esta n\u00e3o \u00e9 do conhecimento oficioso.<\/li>\n
  4. Quando se entender que a investiga\u00e7\u00e3o no inqu\u00e9rito deveria ter sido mais aprofundada, o assistente deve recorrer ao expediente da reclama\u00e7\u00e3o hier\u00e1rquica e n\u00e3o optar pela via da comprova\u00e7\u00e3o judicial da falta de elementos indici\u00e1rios.\n
