  1. Quando a prova produzida n\u00e3o permite a condena\u00e7\u00e3o pelo tipo agravado, a defesa do arguido em nada \u00e9 prejudicada ou surpreendida com a condena\u00e7\u00e3o pelo tipo de crime-base integrante.<\/li>\n
  2. Assim, neste caso, entende-se que a n\u00e3o notifica\u00e7\u00e3o do arguido da altera\u00e7\u00e3o da qualifica\u00e7\u00e3o jur\u00eddica dos factos n\u00e3o impediu a possibilidade de uma defesa eficaz e, como tal, n\u00e3o determina a arguida nulidade da senten\u00e7a.<\/li>\n<\/ol>\n
