Nos termos do Ac\u00f3rd\u00e3o n.º 7\/2005, do S.T.J., publicado no D.R. de 04.11.2005 (I S\u00e9rie), foi fixada jurisprud\u00eancia no sentido de que “N\u00e3o h\u00e1 lugar a convite ao assistente para aperfei\u00e7oar o requerimento de abertura de instru\u00e7\u00e3o, apresentado nos termos do artigo 287º, n.º 2, do C\u00f3digo de Processo Penal, quando for omisso relativamente \u00e0 narra\u00e7\u00e3o sint\u00e9tica dos factos que fundamentam a aplica\u00e7\u00e3o de uma pena ao arguido”.<\/p>\n

E entende-se que tamb\u00e9m n\u00e3o h\u00e1 lugar a tal convite quando tal requerimento n\u00e3o contenha a indica\u00e7\u00e3o das disposi\u00e7\u00f5es legais aplic\u00e1veis (cfr. al. c), do n.º 3, do art.º 283º, do C. Proc. Penal).
