  1. O facto do arguido ser submetido ao teste quantitativo, mais de 2 horas ap\u00f3s a realiza\u00e7\u00e3o do teste qualitativo, n\u00e3o obsta a que a taxa de alcool\u00e9mia acusada releve para efeitos penais;<\/li>\n
  2. O artigo 2º nº 1 da lei 18\/2007, de 17\/5, ao estabelecer que, sempre que poss\u00edvel, o intervalo entre os dois testes n\u00e3o pode ser superior a 30 minutos, indicia que se trata de uma orienta\u00e7\u00e3o, n\u00e3o de vincula\u00e7\u00e3o, pelo que aquela refer\u00eancia n\u00e3o constitui um limite inultrapass\u00e1vel cuja viola\u00e7\u00e3o integre o conceito de proibi\u00e7\u00e3o de prova.
