  1. O arguido n\u00e3o tem legitimidade para recorrer da decis\u00e3o judicial que condenou uma testemunha em multa por ter faltado \u00e0 audi\u00eancia;<\/li>\n
  2. A rea\u00e7\u00e3o a esta condena\u00e7\u00e3o, pela via do recurso, apenas cabe \u00e0 testemunha condenada;<\/li>\n
  3. Tendo o Tribunal a quo verificado a defici\u00eancia da grava\u00e7\u00e3o do depoimento das testemunhas e decidindo-se pela repeti\u00e7\u00e3o da produ\u00e7\u00e3o dessa prova, se as referidas testemunhas n\u00e3o comparecerem nem justificarem a sua falta, recai sobre o Tribunal o poder\/dever de as fazer comparecer, sob deten\u00e7\u00e3o.<\/li>\n
  4. E isto, independentemente do disposto no artigo 331º do CPP quanto \u00e0s regras dos adiamentos, dada a excecionalidade da situa\u00e7\u00e3o, na medida em que se trata de repor uma grava\u00e7\u00e3o defeituosa em estado aud\u00edvel quanto a prova anteriormente j\u00e1 produzida.
