Numa hierarquia de valora\u00e7\u00e3o da prova pericial, os pareceres t\u00e9cnico-cient\u00edficos emitidos pelo Conselho M\u00e9dico-Legal, superam o valor do parecer pericial j\u00e1 que aqueles constituem o entendimento definitivo do conselho sobre a quest\u00e3o concretamente colocada, . a apresenta\u00e7\u00e3o de novos elementos que fundamentem a sua altera\u00e7\u00e3o;<\/li>\n
  2. Ao considerar que o parecer daquele Conselho M\u00e9dico-Legal n\u00e3o era prova pericial, ao considerar que o relator do parecer n\u00e3o era perito, postergando-o, incorreu a senten\u00e7a no v\u00edcio do erro not\u00f3rio na aprecia\u00e7\u00e3o da prova.
