  1. A faculdade de o Minist\u00e9rio P\u00fablico usar do disposto no artigo 16º, nº 3, do CPP, n\u00e3o se restringe apenas ao momento da dedu\u00e7\u00e3o da acusa\u00e7\u00e3o p\u00fablica;<\/li>\n
  2. Tendo o Minist\u00e9rio P\u00fablico requerido o julgamento do arguido perante tribunal singular, e havendo posteriormente a assistente deduzido acusa\u00e7\u00e3o pela pr\u00e1tica de dois crimes de inj\u00faria, a que o MP aderiu, alterados ficaram os pressupostos que levaram a justificar\/fundamentar a posi\u00e7\u00e3o do MP do julgamento do arguido perante o tribunal singular;<\/li>\n
  3. Consequentemente, pode ainda fazer uso da faculdade do artigo 16º, nº 3, do CPP, requerendo a interven\u00e7\u00e3o do tribunal singular em vez de deixar seguir os autos para o julgamento perante o tribunal coletivo;<\/li>\n
  4. \u00c9 que, pese embora o MP j\u00e1 tivesse requerido a interven\u00e7\u00e3o do tribunal singular, tal ju\u00edzo foi feito e apenas vincula quanto aos crimes pelos quais deduziu acusa\u00e7\u00e3o;<\/li>\n
  5. Impunha-se ao Minist\u00e9rio P\u00fablico, caso mantivesse a posi\u00e7\u00e3o de manter o julgamento do arguido perante o tribunal singular, de o manifestar expressa e fundadamente, perante o acr\u00e9scimo de crimes imputados ao arguido.\n
