  1. A correspond\u00eancia entre os factos constantes da acusa\u00e7\u00e3o e os factos constantes da decis\u00e3o final n\u00e3o implica necessariamente a correspond\u00eancia entre os respectivos textos.<\/li>\n
  2. Se o tribunal da condena\u00e7\u00e3o d\u00e1 como assentes factos que j\u00e1 constavam da acusa\u00e7\u00e3o ainda que conferindo-lhes um encadeamento diverso, desde que este lhes n\u00e3o retire a identidade natural\u00edstica, n\u00e3o ocorre qualquer altera\u00e7\u00e3o relevante da mat\u00e9ria de facto, pelo que nem sequer se torna necess\u00e1rio proceder \u00e0 comunica\u00e7\u00e3o pressuposta pela altera\u00e7\u00e3o n\u00e3o substancial.<\/li>\n
  3. Do mesmo modo, se o tribunal descreve os mesmos factos por outras palavras, ou confere maior pormenor ao relato apenas para precisar os termos da ac\u00e7\u00e3o, mas sem acrescentar nada de novo \u00e0 descri\u00e7\u00e3o da ac\u00e7\u00e3o t\u00edpica relevante, n\u00e3o ocorre altera\u00e7\u00e3o substancial ou n\u00e3o substancial da mat\u00e9ria de facto.
