Perante o reenvio do processo, no caso de existir mais de um ju\u00edzo da mesma categoria, na determina\u00e7\u00e3o da compet\u00eancia para novo julgamento, o processo \u00e9 submetido a nova distribui\u00e7\u00e3o, com exclus\u00e3o, naturalmente, do ju\u00edzo a que o processo foi inicialmente distribu\u00eddo.<\/li>\n
  2. A viola\u00e7\u00e3o desta regra legal constitui a nulidade insan\u00e1vel prevista no artigo 119.º, al\u00ednea e), do CPP, que deve ser oficiosamente declarada em qualquer fase do processo.\n
