  1. Para os efeitos do disposto no n.º 4, do art.º 396º, do C. Proc. Penal, a oposi\u00e7\u00e3o ou n\u00e3o oposi\u00e7\u00e3o \u00e0 aplica\u00e7\u00e3o da san\u00e7\u00e3o (que, no \u00faltimo caso, equivale a uma declara\u00e7\u00e3o de culpa, ao menos em termos funcionais) \u00e9 algo a decidir pessoalmente pelo arguido (ainda que sob conselho do defensor), podendo o defensor ser, nos termos legais, o \u00fanico transmissor dessa decis\u00e3o.<\/li>\n
  2. A significar que o defensor pode, representando o arguido, aceitar ou rejeitar as san\u00e7\u00f5es propostas.
