A aplica\u00e7\u00e3o, no caso (pagamento inicial da taxa de justi\u00e7a, como condi\u00e7\u00e3o de abertura da instru\u00e7\u00e3o e san\u00e7\u00e3o pela sua omiss\u00e3o), do disposto no art.º 80º, n.º 3, do C\u00f3digo das Custas Judiciais e n\u00e3o do Regulamento das Custas Processuais, por for\u00e7a do disposto no art.º 27º, n.º 1, do Decreto-Lei n.º 34\/2008, de 26 de Fevereiro (“Aplica\u00e7\u00e3o no tempo”), n\u00e3o padece de inconstitucionalidade, por viola\u00e7\u00e3o do disposto nos art.ºs 13º, n.º 1 e 20º, da Constitui\u00e7\u00e3o da Rep\u00fablica Portuguesa.
E, neste contexto, n\u00e3o tem lugar a aplica\u00e7\u00e3o do disposto no art.º 2º, n.º 4, do C\u00f3digo Penal.
