    \tN\u00e3o podem haver-se, sem mais, como \u201cfalsas declara\u00e7\u00f5es relativas \u00e0 justifica\u00e7\u00e3o de faltas\u201d, prestadas pelo trabalhador, enquanto comportamento constitutivo de justa causa de despedimento, as declara\u00e7\u00f5es m\u00e9dicas (atestado, justifica\u00e7\u00e3o de presen\u00e7a em hospital ou acto m\u00e9dico), apresentadas \u00e0 entidade empregadora pelo trabalhador faltoso, com vista \u00e0 pretendida justifica\u00e7\u00e3o. \t<\/div>\n<\/li>\n

    \tInfringe o dever de lealdade \u2013 corol\u00e1rio do princ\u00edpio geral da boa f\u00e9 na execu\u00e7\u00e3o dos contratos, lembrado no art\u00ba 119\u00ba, n\u00ba 1, do C\u00f3digo do Trabalho \u2013 o trabalhador que, faltando \u00e0s suas obriga\u00e7\u00f5es contratuais, n\u00e3o comparece no local de trabalho, a coberto do atestado de estado de doen\u00e7a, e frequenta, no mesmo per\u00edodo, uma actividade afim em entidade terceira. \t<\/div>\n<\/li>\n

    \tEsse comportamento, porque abala irreparavelmente a rela\u00e7\u00e3o de confian\u00e7a pressuposta na rela\u00e7\u00e3o de trabalho, \u00e9 grave em si e nas suas consequ\u00eancias, constituindo justa causa para despedimento. \t<\/div>\n<\/li>\n<\/ol>\n
