O facto de o sinistrado receber da seguradora uma indemniza\u00e7\u00e3o por ITA e receber da empregadora a remunera\u00e7\u00e3o pelo trabalho efectivamente prestado em per\u00edodo de ITA n\u00e3o implica um qualquer duplo ressarcimento do sinistrado fundado na dita ITA: a indemniza\u00e7\u00e3o por ITA ressarce o sinistrado pela redu\u00e7\u00e3o efectiva da sua capacidade de trabalho; a remunera\u00e7\u00e3o compensa o sinistrado pelo trabalho que efectivamente prestou apesar de se encontrar de ITA e de, por isso, n\u00e3o se encontrar obrigado a prest\u00e1-lo, satisfazendo a empregadora com o seu pagamento a obriga\u00e7\u00e3o que sobre ela impende de remunerar o trabalho que foi efectivamente prestado sem que o sinistrado a tanto estivesse obrigado.
